Rafael García Pérez: “The scope of injunctions in intellectual property cases”

The injunction, being a remedy grounded in equity, has a discretionary nature in English law, in intellectual property as well as in other areas of law. However, intellectual property remedies have been harmonised by Directive 2004/48 on the Enforcement of Intellectual Property Rights. The seminar will consider the impact of this Directive in the power of English courts to award injunctions and damages in lieu of injunctions.
