Preservation and dissemination of cultural heritage has once again become one of the focal points for both the legislator and the judiciary. After Orphan Works Directive (2012/28/EC) and the Directive on Collective Management of Rights (2014/26/EU), the European Commission has now proposed a “package” of legislation that will, among other areas, affect current practices in the cultural heritage sector. Alongside the legislative development, there is currently an ongoing discussion before the Court of the Justice of the European Union in the case of Soulier & Doke (Case C-301/15 – see the Opinion of the Advocate General here), which will have to deal with the question of exclusive rights vis-á-vis collective licensing mechanisms used in the sector of digitization. The seminar will provide an overview and analysis of these recent developments and will contemplate on their possible outcomes.
