{"id":6720,"date":"2021-05-06T18:15:37","date_gmt":"2021-05-06T18:15:37","guid":{"rendered":"http:\/\/microsites.bournemouth.ac.uk\/cippm\/?p=6720"},"modified":"2024-10-23T14:00:08","modified_gmt":"2024-10-23T14:00:08","slug":"collection-of-national-key-enforcement-judgements-related-to-intellectual-property-rights","status":"publish","type":"post","link":"https:\/\/microsites.bournemouth.ac.uk\/cippm\/2021\/05\/06\/collection-of-national-key-enforcement-judgements-related-to-intellectual-property-rights\/","title":{"rendered":"Collection of National Key Enforcement Judgments related to Intellectual Property Rights"},"content":{"rendered":"<p>A <a href=\"https:\/\/euipo.europa.eu\/ohimportal\/en\/web\/observatory\/case-law\">project<\/a> commissioned by the <span class=\"aCOpRe\">Observatory of the European Union Intellectual Property Office (<a href=\"https:\/\/euipo.europa.eu\/\" target=\"_blank\" rel=\"noopener noreferrer\">EUIPO<\/a>) on the Enforcement<\/span><span class=\"aCOpRe\">\u00a0of Intellectual Property Rights<\/span> \u00a0is carried out by CIPPM in collaboration with <a href=\"https:\/\/www.milieu.be\/\">Milieu Consulting SPRL<\/a>.<\/p>\n<p>This 4-year project will run from January 2021 to December 2024, with the objective being to <em>expand, update and consolidate<\/em> the EUIPO\u2019s <a href=\"https:\/\/euipo.europa.eu\/eSearchCLW\/\">eSearch<\/a> Case Law system (database <span class=\"aCOpRe\">including key national case-law in the area of IP enforcement).<\/span><\/p>\n<a href=\"https:\/\/euipo.europa.eu\/eSearchCLW\/\" target=\"_blank\" rel=\"noopener noreferrer\"><img decoding=\"async\" class=\"n3VNCb\" src=\"https:\/\/euipo.europa.eu\/tunnel-web\/secure\/webdav\/guest\/document_library\/observatory\/img\/FACTS_AND_FIGURES\/e-search-case-law.jpg\" alt=\"Case-law\" data-noaft=\"1\" \/><\/a>\n<p>The collection of judgments across EU Member States stems from the <em>European Commission\u2019s Communication: A balanced IP enforcement system responding to today\u2019s societal challenges<\/em> (<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/ALL\/?uri=COM:2017:707:FIN\" target=\"_blank\" rel=\"noopener noreferrer\">COM(2017) 707 final<\/a>) which states that \u2018transparency about judgements on IPR enforcement is an essential pre-requisite for knowledge exchanges across the single market\u2019 and the <em>Council Conclusions on the enforcement of IP rights in the EU<\/em> (<a href=\"https:\/\/data.consilium.europa.eu\/doc\/document\/ST-6681-2018-INIT\/en\/pdf\" target=\"_blank\" rel=\"noopener noreferrer\">6681\/18 1 March 2018<\/a>) which invites Member States to consider in cooperation with the Observatory, the systematic publication of judgements in IPR enforcement cases.<\/p>\n<p>These objectives also form part of the Observatory\u2019s <a href=\"https:\/\/euipo.europa.eu\/ohimportal\/en\/work-programme\" target=\"_blank\" rel=\"noopener noreferrer\">Work Programme 2020<\/a> and is expected to contribute to a \u2018more efficient and predictable juridical enforcement regime in the EU\u2019.<\/p>\n<p>Keeping in step with the above aims, this Collection will take forward the work begun by the EUIPO in 2014 in collecting national key enforcement judgments from the Member States that are related to IPRs.
